I represent and warrant that: 1. I have the right to permit VMakers to perform the VMakers video production and editing services on the materials I have submitted (“Materials”), as identified by my order(s). 2. I have created the submitted work and Materials and I own the full copyright. 3. By submitting content, photos, video, data or other materials directly through the Web site or sent to the VMakers physical location (collectively, "Materials"), I hereby grant to VMakers a perpetual, irrevocable, royalty-free, exclusive, fully transferable and licenseable right and license to access, store, copy, modify, display, distribute, perform, sell, create derivative works from, and otherwise use and exploit all such Materials in any form, media, software or technology of any kind now existing or developed in the future and the right to license and sell the foregoing rights through multiple tiers. I further grant to VMakers a royalty-free right and license to use my name, image and likeness in advertising and in connection with the rights for the Materials. 4. The Materials do not injure, infringe, or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Materials may be viewed or retrieved, 5. VMakers’ provision of the producing, editing, processing and/or hosting of the Materials hereunder will not infringe upon or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, including but not limited to any and all performance license rights, mechanical license rights, synchronization license rights and rights under the Digital Performance Right in Sound Recordings Act of 1995, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Materials can be viewed or retrieved. 6. The Materials and VMakers’ provision of the producing, editing, processing and/or hosting service on my behalf is not for any illegal, commercial, obscene, offensive or immoral purpose.
